Legal Update: Appeal of silfab certificate of occupancy

On February 13, 2026, York County issued a Certificate of Occupancy (CO) for the Silfab facility at 7149 Logistics Lane in Fort Mill. Residents filed an administrative appeal challenging the decision.
The appeal does not challenge construction or inspections. It challenges the underlying zoning determination that allowed a hazardous-chemical manufacturing facility to be classified as Light Industrial (LI).
Under the York County Zoning Code:
Light Industrial explicitly excludes hazardous material treatment or storage.
The Zoning Administrator must issue a formal zoning compliance determination before permits are valid.
The Board of Zoning Appeals (BZA) has authority to review administrative zoning decisions.
Silfab never received a formal zoning compliance approval. Instead, the company received only a zoning verification letter, which clearly states it “does not constitute a permit or full zoning compliance.”
Despite this, York County issued permits and later a Certificate of Occupancy.
Our appeal asks the BZA to determine whether the project was improperly classified under the zoning code, which would invalidate the permits and CO issued for the facility.
County Response
York County declined to process the appeal, claiming the CO falls under the building code rather than zoning.
However, a Certificate of Occupancy cannot legally be issued unless the project complies with zoning laws, making the underlying zoning determination subject to appeal.
South Carolina Law
Under S.C. Code §6-29-800(B), when an appeal is filed, all records related to the decision must be transmitted to the Board of Zoning Appeals for review.
Next Steps
Residents are pursuing additional legal remedies to ensure the zoning code is enforced, including seeking judicial review and further legal action if necessary.
